Trademark registration of artwork – Refusal of registration of the works of Gustav Vigeland
The copyright protection term for the works of Gustav Vigeland expired on 1 January 2014. Oslo Municipality, the custodians of Vigeland’s rights, attempted to trademark several of his works in various iterations with the goal to secure the sole rights to commercial utilization of the aforementioned works.

The London Agreement has now been accepted in Norway, and The Norwegian Patent Act has been amended accordingly.

Music played on radio in rental cars: no obligation to pay compensation
Artists, musicians and producers are entitled to compensation when their music is played on radio or otherwise is performed publicly. This follows from the Copyright Act § 45 b. Payment of compensation is made through the organization Gramo, which collects payments and allots to the various right holders. Gramo has agreements with a number of industries (hotels, shops, clubs, gyms, etc.) that regulates compensation for their use of music.

Changes in goods / services descriptions accepted in Norwegian TM applications
From 1. February 2014 it has been made changes in which description of the goods and services that are accepted as sufficiently specified. The changes only occur for some of the 45 classes. The changes are made in the so called class headings.

New Norwegian Board of Appeal for Industrial Property Rights
Until 1.st April this year all decisions from the Norwegian Industrial Property Office (NIPO) could be appealed to the appeal institute “The Second Instance”. From this date the institute was replaced by the new appeal institute “The Norwegian Board of Appeal for Industrial Property Rights” (BoA). The changes are regulated by the amended Act of 22.nd June 2012, no. 58 regulating the organization of the Norwegian Industrial Property Office.

Award to headphones
We congratulate our client Freebit with success and recognition and having won several prizes. Their licensee Monster has launched their new product iSport Immersion In-Ear Headphones which won the prize ”Best Overall Workout Headphones of 2011”. Freebit has contributed attachment technology protected by patents and a design which also is protected by registration and design patents.

New EU patent and Court
The EU parliament has passed the establishment of a unitary EU patent, and a court for enforcement thereof. Thus, one will be able to apply for an EU patent and enforce it in the whole of Europe through a single, common judiciary system, without the need for acting through the national courts in each member state. As an EPC member but not EU member Norway is excluded, so EPC applications will still be validated in Norway, and enforced through national Norwegian patent court cases.
