Why protect a Trademark?

A trademark registration gives you exclusive rights to use the trademark as a special symbol for your goods and/or services.

It also prevents others from using a trademark which can be confused or misinterpreted with yours for goods and services of the same or similar type.

This exclusive right will hinder others taking advantage of the quality or reputation of your product or services that are well established in the market.

How does one obtain protection?

Trademark protection can be done in two ways, either by registering, or a trademark right is acquired without registration when the trademark is established by use.

The main reason for registering a trademark is that one does not have to document that the trademark is established by use in Norway.

A trademark is considered to be established by use when and for as long as it is well known in the circle of trade in Norway for the relevant goods and services as someone’s sign.

What is a trademark?

A trade mark may for example comprise of words or combination of words (e.g. slogans), names, logo’s, figures and graphics, letters, numbers, sounds or combinations of these.

Your trade mark is the symbol your customers use to pick you out. It distinguishes you from your competitors. You can protect and build upon your trade mark if you register it.
